Planned Giving Interactive, LLC, dba “estategiftplanning.com” (“Estategiftplanning.com,” “we,” “us,” and “our”) are committed to protecting and the privacy of our website visitors, customers, business partners, and end-users.

This Privacy Policy applies to websites and subdomains owned and operated by Estategiftplanning.com (our “Websites”), as well as the products and services offered by Estategiftplanning.com. It explains what information of yours will be collected by Estategiftplanning.com when you access our Websites (including through the websites of our partners), how the information will be used, and how you can control the collection, correction, and deletion of information. The use of information collected through our Websites shall be limited to the purposes under this Privacy Policy and our Terms of Service to customers.

Estategiftplanning.com may, from time to time, handle personal information collected from individuals located within European Union member countries and Switzerland. Estategiftplanning.com complies with the General Data Protection Regulation (“GDPR”) and both the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework as set forth by the U.S. Department of Commerce regarding the collection, use, onward transfer, processing, and retention of personal information from European Union member countries and Switzerland. Estategiftplanning.com commits to cooperate with the Swiss Federal Data Protection and Information Commissioner (SFDPIC) and comply with the advice given concerning human resources data transferred from Switzerland in the context of the employment relationships under the Swiss-US Privacy Shield.

What information do we collect about you?

We may collect personal information about you when you visit our Websites. You provide some information. For example, first name, surname, address, telephone number, email address, and organization (personally identifiable information, or “Personal Information”) when you complete our online form requesting information about our products or services. We also collect personally identifiable information when you order or register our products or services, subscribe to marketing communications, request support, complete surveys, provide in product feedback, participate in any of our Website blogs or discussion groups, participate in an online live chat, or when you sign up for an Estategiftplanning.com sponsored event or webinar.

When you purchase our products, purchasing Estategiftplanning.com products or services, we may also collect billing and transactional information through Estategiftplanning.com or our secure payment provider, Stripe.com.

When using Estategiftplanning.com products and services. In connection with using certain Estategiftplanning.com products and services, we may automatically collect some data regarding the performance and configuration of the Estategiftplanning.com products and services, our customers’ and their end-users consumption of and interaction of such products and services (“Usage Data”). Through our Customers. Our customers and their end-users may submit or upload information to Estategiftplanning.com’s services for hosting or storage in the course of using our products and services. Estategiftplanning.com processes this customer content on behalf of the customer. Our privacy practices will be governed by the contract that we have in place with our customers, and this Privacy Policy will not apply to any personal information contained in such customer content. Following such terms, Estategiftplanning.com will process customer content to provide the relevant Estategiftplanning.com services and follow our customer’s instructions. Suppose you have any questions or concerns about how such information is handled. In that case, you should contact the person or entity who has contracted with Estategiftplanning.com to use the Estategiftplanning.com service to host or process this information (e.g., your employer). We will assist our customers in addressing any concerns you may have following our contract terms with them.

How will we use the information we collect?

To whom do we disclose the information we collect?

Partners: We may provide your information to our channel partners, such as distributors and resellers, to fulfill product and information requests, to effectively deliver unified support, and to provide customers and prospective customers with information about Estategiftplanning.com and its products and services.

We will process your request following the GDPR. We may need to retain certain information for record-keeping purposes and complete transactions that you began to request any deletion. Right not to provide consent or to withdraw consent: We may seek to rely on your consent to process certain personal information. Where we do so, you have the right not to provide your consent or to withdraw your consent at any time. This does not affect the lawfulness of the processing based on consent before its withdrawal.

Right of erasure: In certain circumstances, you may have the right to the erasure of personal information that we hold about you (for example, if it is no longer necessary for the purposes for which it was initially collected).

Estategiftplanning.com has no direct relationship with our clients’ customers or third-party whose Personal Information it may process on behalf of a Client. An individual who seeks access or seeks to correct, amend, delete inaccurate data or withdraw consent for further contact should direct his or her query to our client company they deal with directly. If our client requests estategiftplanning.com to remove the data, we will respond to its request within thirty (30) days. We will delete, amend or block access to any Personal Information that we are storing only if we receive a written request to do so from our client responsible for such Personal Information; unless we have a legal right to retain such Personal Information. We reserve the right to retain a copy of such data for archiving purposes or defend our litigation rights. 

California Privacy Rights: California Civil Code section 1798.83 requires us to disclose to our California customers, upon request, the identity of any third parties to whom we have disclosed Personal Information within the previous calendar year, along with the type of personal information disclosed, for the third parties’ direct marketing purposes. Please note that we are only required to respond to a customer request under California law once during any calendar year.

Besides, California Business and Professions Code Section 22581 requires that we allow California residents under age 18 who are registered users of online sites, services, or applications to request and obtain removal of content or information they have publicly posted. Such requests should include a detailed description of the specific content or information to be removed. Please be aware that your request does not guarantee complete or comprehensive removal of content or information posted online and that the law may not permit or require removal in certain circumstances.

How long we retain your information?

We will retain personal information we collect from you where we have a justifiable business need to do so and for as long as is needed to fulfill the purposes outlined in this Privacy Policy unless a more extended retention period is required or permitted by law (such as tax, legal, accounting or other purposes). You can request the deletion of your personal information at any time (see “Your Privacy Rights” section for further information), and we will consider your request following applicable laws.

When we have no justifiable business need to process your personal information, we will either delete or anonymize it, or if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

What are Cookies, and how do we use them?

Cookies are small files that a site transfers to your computer’s hard drive through your web browser, enabling it to recognize your browser and capture and remember certain information. A cookie cannot read data from your hard drive or read cookie files created by other sites. Cookies may do things like allow you to navigate faster through the site, remember your preferences, passwords, and generally improve the user experience. We do not share any information with these third parties that would readily identify you (such as email address); however, these third parties may have access to information about your device (such as IP or MAC address). We do not have access to or control over the technologies that these third parties may use to collect information about your interests. This Privacy Policy does not cover the information practices of these third parties. Other than as discussed in this document, we have no control over these third parties.

Children

Our Websites, products, and services are not directed to individuals under the age of 18. We do not knowingly collect personal information from such individuals. If we become aware that an individual under 18 has provided us with personal information, we will take steps to delete such information.

International transfers of information

Personal information, including personal information collected in the European Economic Area (“EEA”) or Switzerland, may be transferred, stored, and processed by our services providers and us partners, and affiliates in the United States and potentially other countries whose data protection laws may be different to the laws of your country, for example to Canada. 

We will not transfer Personal Information originating in the EU or Switzerland to third parties unless such third parties have entered into an agreement in writing with us requiring them to provide at least the same level of privacy protection to your Personal Information as required by the Principles of the EU-US Privacy Shield Framework or the Swiss-US Privacy Shield Framework. We will only transfer data to our agents, resellers, or third-party service providers (such as accountants, attorneys, consultants, and other service providers) who need the information to provide services to or perform activities on behalf of estategiftplanning.com; including in connection with the delivery of services or products, estategiftplanning.com’s management, administration, or legal responsibilities. We acknowledge our liability for such data transfers to third parties.
